Pop-Up Play (PTY)Ltd website allows customers to book soft play equipment for any type of function that requires entertainment for tots up to the age of 4 years.  Pop-Up Play (PTY)Ltd may, in its sole discretion, change these terms and condition or any part thereof at any time without notice. Please note that calls will be answered between 13:30 pm and 17:00.  Due to the nature of our business, we are on the road allot. We therefore cannot answer all calls, thus please send us an email and we will get back to you as soon as we can.

    • Bookings are made online only by visiting www.popupplay.co.za
    • Please note the invoicing process is an automated invoicing system.  Thus you will receive the invoice within a few minutes after you made your booking online.  Please make double sure all details are entered correct as Pop-Up Play (PTY) Ltd will not be held liable for any information that is not correct.
    • 50% Deposit is required at the time of making the booking.
    • Bookings are only finalized when a deposit is paid and received by Pop-Up Play (PTY) Ltd.
    • It is the customer’s responsibility to inform us that payment has been made.  It is not the responsibility of Pop-Up Play (PTY) Ltd or any employee of Pop-Up Play (PTY) Ltd to pursuit the customer for the deposit.
    • Proof of payment must be sent to us (bookings@popupplay.co.za) to inform us when a payment has been made. If you, the customer, skip this step then your booking will unfortunately not be confirmed and your booking will automatically be cancelled 24 hours after our system has sent you the invoice.
    • The balance is due 72 hours prior to delivery.  Failure to do so may result in the equipment not being delivered.
    • A Deposit will only be refunded if the booking is cancelled 21 (TWENTY ONE) days or more prior to the booking date.
    • No refunds will be made for bad weather.  It is the customer’s responsibility to check the weather forecast and make necessary arrangements if required.
    • The good news is, come rain or snow, you will still be able to use our equipment as the equipment is not restricted to being outdoors only. You can even bring on the load shedding as we do not need electricity in order to have fun.
    • The equipment is designed for children up to 4 years old and must not be used by adults. Please respect our equipment.
    • Please note that our equipment may get hot while standing in the sun. It will be in the children’s best interest if you provide cover for the children to protect them against UV from the sun and preventing the equipment from getting hot.
    • In the event of rain, our equipment must be covered or taken indoors. Please do not allow children on wet equipment as it will become very slippery.
    • No children are allowed on our equipment if responsible adult supervision is not available.
    • It’s the responsibility of the hirer to supervise all children whilst using our equipment.
    • Any damaged to our equipment will be charged at full replacement value.
    • Please do not set any arts and crafts tables up near our equipment.  Any marks made on the fabric of our equipment will make a stain. This will then render the equipment as damaged. No paint, pencils, crayons, playdoh, drinks, food, sweets or even the delicious cake that you made allowed on our equipment.
    • Collections take place strictly on the day of the event.  
    • The equipment must be returned the same day of collection unless mutually agreed otherwise by both parties.
    • What to bring when you collect:  
    • R500 security deposit if not paid already. This will be refunded to you when we receive the goods back in good, clean condition. 
    • I.D or Driver’s License – this is just to make sure that we know you are who you say you are when you collect our goods and drive away with it.  If you send a driver, he or she will have to show us some form of identity.  Please note that we will also make note of your number plate.  

     

    • All equipment to be used at own risk.
    • By paying the 50% deposit and/or by accepting delivery of rented items, the customer agrees to all terms and conditions.
    • The Hirer/Customer assumes full responsibility for all rented items, including their safe and proper use, and return to Pop-Up Play (PTY)Ltd.
    • The Hirer/Customer agrees to indemnify and hold Pop-Up Play (PTY)Ltd harmless from any claims from customers use or misuse, including any third parties for loss, injury, and damage to persons or property arising out of the customer’s negligence or operation including legal costs incurred in defence of such claims.
    • The Hirer/Customer acknowledges the possibility of injury and will provide adult supervision at all time.
    • The Hirer/Customer will be liable for any damage/theft of the equipment whilst in their care. All damages incurred to any hired equipment while in possession of the hirer will be payable by the hirer unless mutually agreed upon in writing by both parties.
    • The Hirer/Customer agrees to pay all attorney fees and court costs incurred by Pop-Up Play (PTY)Ltd in enforcing these terms and conditions.
    • The onus rests on you as our dearest customer to:
    • Provide all correct contact details, address and party times when making the booking.
    • To read and accept our Terms and conditions, FAQ’ and ask questions if you are unsure about anything.
    • To pay the deposit within 24 hours after making the booking.
    • To send us the POP and to confirm that we have received the deposit/POP if not paid via Credit card.
    • To be at the given delivery address to accept the goods as per the agreed delivery and collection times between the customer and Pop-Up Play (PTY)Ltd.
    • It will be required that the person receiving the goods will have to check that all goods were received in good working condition. If not, please do not use the equipment and report it to us immediately.
    • To make sure that all the guest are using our equipment responsibly.
    • Provide supervision at all times.
    • Keep your beloved pets away pets away from our equipment.
    • To deliver the equipment that you booked to the given address provided by you at the agreed time between you and Pop-Up Play (PTY) Ltd.
    • Pop-Up Play (PTY) Ltd shall take all reasonable steps to protect the personal information of users/customers.  For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000(PAIA).  The PAIA may be downloaded from http://www.polity.org.za/attachment.php?aa_id=3569 
    • Payment may be made via Visa and MasterCard credit cards or by electronic fund transfer (EFT) into Pop-Up Play (PTY) Ltd bank account, the details of which will be provided to you once you have completed the booking process online via our website https://www.popupplay.co.za
    • All refunds will be processed and a credit will be automatically applied to your credit card or original method of payment within 7 – 10 working days. Please note that depending on your Credit Card Company or bank, it may take additional 2-10 business days for the amount to reflect on your account.
    • Credit card transactions will be acquired for Pop-Up Play (PTY) Ltd via PayGate (PTY) Ltd who are the approved payment gateway for Standard Bank of South Africa.  PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.  Users may go to www.paygate.co.za to view their security certificate and security policy.
    • The merchant outlet country at the time of presenting payment options to the cardholder is South Africa.  Transaction currency is South African Rand (ZAR)
    • Pop-Up Play (PTY) Ltd takes responsibility for all aspects relating the transaction including sale of the goods and services sold on the website, customer services and support, disputes resolution and delivery of goods.
  • As parents, we know that children get hurt, no matter how much “padding is on your walls”.  We do not promise that there will be no tears while using our equipment, but here is a few tips to try and minimise those heart-breaking tears:

    • All our equipment is soft and padded, but please makes sure that there is no hard or sharp edges around, as children may tumble off our equipment and knock against other hard surfaces.  
    • Encourage children to move along and not plonk down in the middle of the track causing a traffic jam.  Traffic jams tend to form in the tunnels or on top of the slides.
    • Encourage children to sit inside ball ponds and not on the edges as they may fall off and get a bump on the head.
    • Discourage the little ones running onto or near the equipment as it poses a potential risk of injury.
    • Ensure the equipment isn’t overcrowded.  Limit numbers according to the age and size of the children using it.
    • The equipment must not be used for water sports or setup near water.  The surface of the equipment becomes very slippery when wet.
    • Allow the children to explore and have fun while keeping your hawk eyes and spider-senses alert.
